By accessing or using the Pet Panic Button application ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

Pet Panic Button is developed in partnership with Bayvets Runaway Bay, a registered veterinary practice located on the Gold Coast, Queensland, Australia. Our triage algorithms are reviewed and validated by practising veterinarians.

3. Description of Service

Pet Panic Button provides a digital triage assessment tool designed to help pet owners determine whether their pet may need veterinary care. The Service is developed in partnership with Australian veterinary professionals.

4. User Responsibilities

When using the Service, you agree to:

• Provide accurate and complete information about your pet's symptoms
• Use the Service only for its intended purpose of pet health triage
• Not rely solely on the Service in emergency situations
• Seek professional veterinary care when in doubt about your pet's health
• Not attempt to reverse-engineer, copy, or misuse the Service

5. Subscription and Payments

The Service offers various subscription options including:

• Free tier with first 3 triage assessments free
• Pay-as-you-go per-assessment pricing
• Annual subscription with unlimited assessments

Purchases made inside the iOS app are processed through Apple's App Store payment system and are governed by Apple's standard terms and refund policies. Credit pack purchases made on this website are processed by Stripe.

We offer a 30-day money-back guarantee on annual subscriptions — full refund, no questions asked. For in-app purchases, request a refund via reportaproblem.apple.com or contact [email protected] and we will assist you. For credit packs purchased on the website, email [email protected] within 30 days of purchase for a refund on unused credits.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that: (a) the Service will be uninterrupted, secure, or error-free; (b) the results obtained from using the Service will be accurate or reliable; (c) any errors will be corrected; or (d) the urgency assessments will correctly identify the severity of any pet health condition.

7. Limitation of Liability

To the maximum extent permitted by Australian law, Pet Panic Button, Bayvets Runaway Bay, and their officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Any damages resulting from personal injury or pet injury arising from your use of or inability to use the Service
• Costs of substitute services or veterinary care

Our total liability for all claims arising from your use of the Service shall not exceed the greater of: (a) the amount you paid to us in the twelve months prior to the event giving rise to liability, or (b) one hundred Australian dollars (A$100.00).

Nothing in these Terms excludes, restricts, or modifies any consumer rights under the Australian Consumer Law (ACL) that cannot be excluded, restricted, or modified by agreement.

8. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, are the exclusive property of Pet Panic Button and are protected by Australian and international copyright, trademark, and other intellectual property laws.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

11. Changes to Terms

We may modify these Terms at any time. We will notify users of any material changes via the app or email. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.
